Terms and Conditions

Material on our sites is mostly provided by Accommodation Gateway ABN 62 298 895 865 trading as Accommodation Gateway and employees (us, we, our).

This website, BookBlueMountainsOnline.com.au is owned and operated by Accommodation Gateway ABN 62 298 895 865 and is offered to you conditioned on your acceptance of the following document without modification of the terms. By accessing this website you agree to total acceptance of all terms and conditions contained herein. If at any time the terms and conditions of this agreement are no longer acceptable to you, you should immediately cease use of the website.

Use of the 'Booking Service’ and website by you ("the Customer") is subject to the following terms and conditions:

Bookings made to ‘the 'Booking Service’ by the Customer are made on behalf of the accommodation provider. The Customer agrees that the Accommodation provider has sole responsibility for delivery of the services being booked by the Customer and that ‘the 'Booking Service’ is not liable for default by the accommodation provider.
The Customer agrees to pay to ‘the 'Booking Service’ by debit to Customer's credit card account the specified booking fee and cost of the accommodation. All fees are Tax inclusive where applicable. The 'Booking Service’ will issue the Customer with a valid confirmation in respect of this booking service.
‘the 'Booking Service’ receives a payment from the accommodation provider for providing this booking service.
The customer acknowledges that a third party ("Card Authoriser") will process the credit card transactions required in respect of a booking. The Customer agrees that the 'Booking Service’ is not liable for default by the Card Authoriser.
Cancellation penalties depend upon individual accommodation provider policies. A $20 administration fee applies to all booking cancellations and amendments.
You may be required to present photo ID on arrival at the accommodation provider premises. A credit card imprint or cash deposit may be required to cover incidental charges.
Information on the ‘the 'Booking Service’ website is based on information supplied by each accommodation provider. Whilst the 'Booking Service’ endeavours to ensure all information presented is accurate, it makes no guarantee that the information is free from errors or faults, and accepts no liability for any errors or omissions as all information in relation to accommodation and premises is provided by the accommodation provider.
The 'Booking Service’ makes no warranty or representation about the suitability of any product or service being advertised on its website.
The 'Booking Service’ does not pay commissions to travel agents using this booking service.
The 'Booking Service’ reserves the right to change information published on its website at any time.
The 'Booking Service’ needs to collect personal information about you to process your booking for accommodation. If the 'Booking Service’ cannot collect this information, it will be unable to make a booking in your name. The 'Booking Service’ respects your privacy and will only use or disclose your information in accordance with the Privacy Act 1988. Please read our privacy policy.
If you wish to make a booking, we will provide your information to the accommodation provider so that your booking may be processed.
This agreement is governed by the laws of where the 'Booking Service' is located (unless otherwise specified) and the parties agree to the appropriate jurisdiction for any legal proceedings arising out of this agreement.

This Privacy Agreement outlines the way in which BookBlueMountainsOnline.com.au collects, holds and discloses information we hold about accommodation establishments. BookBlueMountainsOnline.com.au collects information necessary for us to provide our accommodation information & booking services.

All of the information on this website is for informational purposes only. While BookBlueMountainsOnline.com.au makes every effort to ensure that all information displayed on this website is accurate, necessary and complete, none of the information on this website should be considered solely reliable for use in making bookings purchases of services, goods or any type of financial decisions. BookBlueMountainsOnline.com.au shall not be liable for any direct, indirect, incidental, punitive, special or consequential losses or damages as a result of this site or the information contained in this website.

BookBlueMountainsOnline.com.au enlists the services of a third party payment processor, and shares with this firm any details collected enabling them to carry out the transaction for booking the accommodation. BookBlueMountainsOnline.com.au also shares your information submitted to the accommodation provider where you are making the booking.

Outside of this agreement, BookBlueMountainsOnline.com.au does not rent, sell, or share any information on this website with other people, businesses or companies other than the direct contact/booking form that is used for you to contact the accommodation owners needed to process accept or decline the booking.

BookBlueMountainsOnline.com.au is located in NSW Australia and is governed by, and adheres to the Privacy Act 1988 (Cth) which follows the 11 National Privacy Principles (http://www.privacy.gov.au/publications/npps01.html). Reliance and Waiver

We will not accept any claim, by you in relying on any material contained in, or omitted from our sites, whether due to our negligence, or the negligence or even dishonesty of renters or owners. In return for access to or the publication of material on our site you agree not to make any claim against us

We treat the personal information of users of our site with respect and confidentiality and take all reasonable steps to ensure that your personal information is stored securely and accurately. If at any stage you have information we have stored that you wish to change please let us know and we will only amend.

Acceptable use: Your use of our sites

A condition of your use of our sites is that you promise not to use our sites for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws or regulations.

Governing Laws

The laws of the state of New South Wales, Australia, govern these terms and conditions. You as a renter or owner, regardless of the situation of the property, or where you are located, agree to submit to the jurisdiction of the courts of New South Wales.

Renters

You agree not to claim against us for the failure of a booking, for whatever reason.

If you are intending to stay at one of the properties described on our sites, you must rely entirely on your own enquiries and satisfy yourself as to the accuracy of the material on our sites. Whilst we may provide the initial means of booking service and contact between you, and the property we take no responsibility whatsoever for any transaction entered into between you and the owner outside of the booking payment which is set by the accommodation providers themselves which we deliver to property owners.

We cannot promise that

1. The person administering a property is the owner or registered proprietor of that property.

2. That they have appropriate safety standards or insurance coverage. The prices are fixed by the owner, we have absolutely no involvement in determining the:

1. Price, value, suitability or of the safety for you or those accompanying you on any stay.
In return for your access to material on our site you agree not to make any claim against us. You agree to leave the property in a condition similar to that in which you found it and to report all damage and loss to the owner.

Owners

You agree not to claim against us for the failure of a booking, for whatever reason.

We take reasonable care to transcribe your material into an online format. However, we reserve the right to edit or condense material in any way we see fit and you agree not to claim against us for any change we make. In consideration of the publication of material you supply to us you agree not to make any claim against us including anything caused by our negligence. We reserve the right to refuse any material based completely on our own discretion.

In renting out your property you must rely entirely on your own enquiries and satisfy yourself as to the accuracy of the material sent to you by our site or appearing on our site, Whilst we may provide the initial means of contact between you, and the renter we take no responsibility whatsoever for any transaction entered into between you and the renter outside of the booking payment which we deliver to you.

You agree to make no claim for:
1. The conduct or behavior of renters,

2. Anything from a failed booking

3. The non-payment of a tariff or rent

4. The state in which the property is left, or

5. Damage which may be done to the property or neighbors

6. The loss of any data or records stored by us. In consideration for the publication of your material on our site you agree not to make any claim against us.

By placing material on our sites you give us a license to use that material, including altering it in any way, allowing us to use it as we see fit in any media anywhere in the world. (See copyright section)

You agree to provide material that is truthful about the property, that is quiet, clean and safe to use as a rental property and that you have appropriate insurance cover for your own losses and claims that might be made against you by renters their guests and your neighbors. Where renters do not have exclusive use of the property or facilities this should be clearly explained.

Definitions

Negligence: wherever used includes our negligence as well as the deliberate or negligent acts of others
Sites: means all websites, Internet access portals, URL's capable of being accessed by a browser, including WAP and other formats operated and maintained by you

Material: means Text, graphics, photos, other media and or any information on our sites

Us, we, our: means owned and operated by Accommodation Gateway ABN 62 298 895 865 and employees Truth: Means reliability, accuracy or completeness

Claim: means a demand for payment, or rectification, or publication whether by litigation or otherwise and includes the loss or damage claimed and legal costs incurred

Promise: means a guarantee, warranty or representation

Renter(s): means person seeking to enquire about or stay at properties or accommodation referred to in material on our sites

User Agreement The information presented by this siteis deemed to be accurate, but it has not been independently verified. We make no guarantee, warranty or representation. It is the user's responsibility to independently confirm accuracy and completeness.

User Conduct

User agrees to abide by all applicable local, state, national and foreign laws, treatises and regulations in connection with the service. The user agrees to not transmit or post information that is harmful to other members.
Termination

This website in its sole discretion, may terminate user's password, account or use of the service and remove and discard any data within the service if user fails to comply with this Agreement. User may terminate the service upon notice to this website at any time; however, user will not receive a refund of any portion of fees paid. Upon termination, user's rights to use the service, web solutions, domain name, design and associate technologies will also terminate.
Indemnification

User shall indemnify and hold Accommodation Gateway and its parents, subsidiaries, affiliates, officers, directors, employees, attorneys, and agents, harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including attorneys' fees and costs) arising out of, or in connection with user's use of the service (including the content) or breach of this
Agreement.

Limitation of Liability

In no event shall this website aggregate liability exceed the amount actually paid by user in the twelve (12) month period immediately preceding the event giving rise to such a claim. In no event shall Accommodation Gateway be liable to anyone for any indirect, punitive, special, exemplary, incidental, consequential or other damages of any type or kind arising out of, or in any way connected with this service, including but not limited to user's use or inability to use the service or for any content obtained from or through the service, even if Accommodation Gateway has been.
